Case Analysis Directions
Do NOT provide an in-depth coverage or report of the case itself but rather analyze it- the findings, the implications. The ‘bigger picture’ – don’t focus on the person but rather the issue at hand.
I. Case Background
A quick summary of the pertinent facts and legal points in the case. Make sure to identify the relevant law.
(1) Be sure to identify who is affected, nature of the problem, key factors, and factors associated with the problem.
(2) Identify who are the key figures most affected by the decision
(3) Identify the public health problem the case is focused on. State the problem meaningfully.
(4) What was the event or series of event that was a catalyst for the case?
(5) Identify what and whose interests are at stake (ie state or federal government, private corporations, personal rights etc)
(6) Use data and sources to support your statements
Keys: Make sure you describe the nature of the case, a statement, identifying and addressing the relevant law, a short summary of the case. Explain who did what to whom and why the case is being presented. Include a summary of the pertinent facts and legal points raised in the case.
II. Reasoning and opinions
Identify how and where this case has been addressed in the courts.
(1) Identify the actions taken by the courts
(2) Where has the case been heard, what was the decision of the case.
(3) Any appeals? How far have the appeals been heard- state, federal?
(4) If this case is being heard in the Supreme Court, identify how each justice voted. What was the decision? Was a policy created? A law upheld?
This is the most important aspect of the assignment.
(1) Evaluate the significance of the case
(2) Its relationship to other cases, its place in history, and what it shows about the Court,
(3) What impact might the decision have on those not immediately involved
(4) Discuss the impact it has on government, society, and public health implications. Go into depth here.
